Energy Department Says It Has ‘Mandate’ to Force ‘Market Transformation’ for Household Appliances

Assistant Energy Secretary Cathy Zoi said Thursday that the U.S. Department of Energy has a “mandate” to issue regulations to determine what household appliances are available to Americans in the future.

Speaking at the inaugural meeting of the recently reestablished Secretary of Energy Advisory Board (SEAB), Zoi pointed to four tactics the Obama administration intends to use to advance the “deployment of clean energy.”

The first three include government subsidies for private-sector green energy projects; special tax incentives for green energy projects; and low-interest government-backed loans for green energy projects.

“The fourth one, which the secretary and I love,” said Zoi, “is where we have a mandate. Where we can actually just issue regulations and do market transformation.”

Zoi was referring to authority the department has under the Energy Policy and Conservation Act of 1975, as amended by the Energy Policy Act of 2005. That law gives the DOE the power to set efficiency standards for energy-consuming products.

Civil law (or Civilian Law) -  is a legal system inspired by Roman law, the primary feature of which is that laws are written into a collection, codified, and not (as in common law) determined by judges. Conceptually, it is the group of legal ideas and systems ultimately derived from the Code of Justinian, but heavily overlaid by Germanic, ecclesiastical, feudal, and local practices, as well as doctrinal strains such as natural law, codification, and legislative positivism. Materially, civil law proceeds from abstractions, formulates general principles, and distinguishes substantive rules from procedural rules. It holds legislation as the primary source of law, and the court system is usually inquisitorial, unbound by precedent, and composed of specially trained judicial officers with a limited ability to interpret law.

The principle of civil law is to provide all citizens with an accessible and written collection of the laws which apply to them and which judges must follow. It is the most prevalent and oldest surviving legal system in the world. Colonial expansion spread the civil law system and European civil law has been adopted in much of Latin America as well as in parts of Asia and Africa. The primary source of law is the legal code, which is a compendium of statutes, arranged by subject matter in some pre-specified order; a code may also be described as “a systematic collection of interrelated articles written in a terse, staccato style.” Law codes are usually created by a legislature’s enactment of a new statute that embodies all the old statutes relating to the subject and including changes necessitated by court decisions. In some cases, the change results in a new statutory concept. The two other major legal systems in the world are common law and Islamic law.

Security Tackles and Chokes Deaf Customer for Failure to Respond

Two deaf shoppers at XXI in Los Angeles, CA were approached by security and asked for their receipts. One was tackled and choked for an extended length of time while the other pleaded with security to stop, trying to explain that they are deaf. Police responded and arrested the alleged shoplifter for robbery and assault. By the looks of this video, it is hard to imagine how the deaf man laying on the ground turning purple from lack of oxygen assaulted anyone.

Bob Marley’s Family Loses Case Over Hit Records

Bob Marley’s family lost a lawsuit seeking the copyrights to several of the late Jamaican reggae singer’s best-known recordings.

U.S. District Judge Denise Cote in Manhattan said the UMG Recordings unit of Vivendi SA’s Universal Music Group is the rightful owner of copyrights to five albums that Marley had recorded between 1973 and 1977 for Island Records.

The albums “Catch a Fire,” “Burnin’,” “Natty Dread,” “Rastaman Vibrations” and “Exodus” were recorded with Marley’s band The Wailers. They include some of Marley’s best-known songs, including “Get Up, Stand Up,” “I Shot the Sheriff,” “No Woman, No Cry” and “One Love.”

Marley died of cancer in 1981 at age 36.

Friday night’s ruling is a defeat for Marley’s widow Rita and nine children who had sought to recover millions of dollars in damages over UMG’s effort to “exploit” what they called “the quintessential Bob Marley sound recordings.”

L. Peter Parcher and Peter Shukat, who are lawyers for the family, did not immediately return calls seeking comment. UMG spokesman Peter LoFrumento said the company is pleased with Cote’s ruling.

The 5 Pillars of Food Safety

The USA is presently the richest and scientifically the most advanced country in the world. Its people spend proportionately the least amount of their incomes on food supply. On the other hand, the incidence of food-borne disease (FBD) in this country is the highest anywhere on the earth. The closest example of another country in this regard is Canada.

The source of FBD during approximately the last 50 years is reported to originate from indiscriminate application of the following five substances in food production: hormones, antibiotics, slaughterhouse wastes, Genetically Modified Organisms and pesticides. The types of FBD that these substances induce include cancer, antibiotic-resistant infections, neurological conditions, including BSE/CJD, diabetes, obesity, cardiovascular diseases, and immune, reproductive and other disorders.

None of the five substances is proved to be safe as required under the Food and Drugs Act of either U.S. or Canada. However, the first three of these products, i.e. hormones, antibiotics and slaughterhouse wastes, are unequivocally banned to be utilized in food production throughout the European Union countries. Consequently, U.S. and Canadian beef is not allowed to be imported into EU countries. However, the U.S. and Canadian regulatory authorities argue that the incriminating substances pose no risk to human health. Therefore, the issue is being contested before the World Trade Organization for approximately the last two decades.

Meanwhile, all five of these products continue to be marketed contrary to the Food and Drug Act of both U.S. and Canada. It is time to revise these policies and thereby protect public health and safety. In doing so, one would invoke what I refer to as the Five Pillars of Food Safety.

Pennsylvania Homeland Security Puts Anti-tax Protesters On List of Terror Threats

The Pittsburgh Tribune-Review reports Pennsylvania’s Democrat governor Ed Renell is “deeply embarrassed” by the disclosure that state Homeland Security officials have designated anti-tax protesters and other folks exercising their First Amendment right to petition the government as a threat to the state’s infrastructure.

“I am appalled by the information that was disseminated,” Rendell said. “Let me make this as clear as I can make it: Protesting is not a threat against infrastructure. Protesting is a God-given American right.”

Pennsylvania paid a Philadelphia-based nonprofit $125,000 to compile the list as part of the state Homeland Security’s federally mandated mission to protect public infrastructure. Homeland Security officials distributed the list in a security bulletin to government and law enforcement officials, universities and gas drilling companies, according to the Pittsburgh Tribune-Review. The company, which also has offices in Washington and Jerusalem, provides “actionable intelligence briefings” and “threat and hazard monitoring,” among other services, according to its website.

“I thought we were in America, and to me that’s almost like communism,” Barbara Pribila of the Lincoln Place Action Group, a Pittsburgh neighborhood group opposed to shale gas drilling, told the newspaper. “I thought this was a free country and I was allowed to have my own opinion. Now what, you’re going to watch me and every move I make? That’s not right.”

Hip-Hop Theater Festival Celebrate 10-Years With New Program

Later this month, the Hip-Hop Theater Festival (HHTF) will celebrate its 10-year anniversary with live, professionally executed theater written by members of the Hip-Hop generation, organizers told AllHipHop.com today (September 16th).

The HHTF has collaborated with leading arts venues, including Dance Theater Workshop and Harlem Stage, to create fully produced main stage works, youth performances, staged readings, open rehearsals, master classes, panel discussions and workshops.

Additionally, HHTF has tapped pioneering Hip-Hop dancer Ken Swift, whop will present Swift Solos with contemporary dance company Dance Theater, on September 29th.

HHTF will also host the New York premiere of Don’t Hit Mama’s Dance Party at the Harlem Stage Gatehouse, SEED by Radha Blank and “Where My Girls At?,” a one-woman show about black lesbianism.
