Marcus Garvey

 

Marcus Mosiah Garvey, Jr. was a Jamaican publisher, journalist, entrepreneur, and orator who was a staunch proponent of the Black Nationalism and Pan-Africanism movements, to which end he founded the Universal Negro Improvement Association and African Communities League (UNIA-ACL). He founded the Black Star Line, part of the Back-to-Africa movement, which promoted the return of the African Diaspora to their ancestral lands.

 

Prior to the twentieth century, leaders such as Prince Hall, Martin Delany, Edward Wilmot Blyden, and Henry Highland Garnet advocated the involvement of the African diaspora in African affairs. Garvey was unique in advancing a Pan-African philosophy to inspire a global mass movement and economic empowerment focusing on Africa known as Garveyism. Promoted by the UNIA as a movement of African Redemption, Garveyism would eventually inspire others, ranging from the Nation of Islam to the Rastafari movement (which proclaims Garvey as a prophet). The intent of the movement was for those of African ancestry to “redeem” Africa and for the European colonial powers to leave it. His essential ideas about Africa were stated in an editorial in the Negro World titled “African Fundamentalism.” Some of Garvey’s works are Message to the People, The Poetical Works of Marcus Garvey, and The Marcus Garvey and Universal Negro Improvement.

Anonymous Attacks MPAA, RIAA, DOJ, BMI, & HADOPI

Anonymous, the rogue group responsible for some of the most, if not expansive, blunt online activist movement of all time is well underway in proving to major corporations and government agencies around the world that they are here to stay – in more ways than one.

Techland, a Time magazine division, is reporting this evening that Anonymous has successfully shut down the Department of Justice website, (DOJ,gov - Ooops!), and fellow NERD site, Gizmodo, was one of the first to spot Anonymous’ earlier expressive tweets of victory.

The Anonymous group was not done. They have managed to mingle themselves in the Universal Music Groups website, the MPAA (Motion Picture Association of America), RIAA (Recording Industry Association of America), the U.S. Copyright Office, music publishing and licencing group, BMI, and French copyright enforcement agency HADOPI.

Most of these websites are back on their feet, but it would appear the two hardest hit were the DOJ site and the Universal Music Group. It would appear that a Russian news service, according to Gizmodo, is claiming that this is the most expansive series of DDoS attacks ever seen in history. Gizmodo has also reported the most recent word from an Anonymous entity:

We don’t condone the use of hacking of any kind, but call it what you may, hackers, activist, hacktivist, online terrorism, in any case, this truly is a perplexed unprecedented event of our time. One of which I believe will be in history books to come.

What’s next? Blackout SOPA & IPA? Erase any trace of it ever known on any computer/server worldwide? You never know!

French Presidential Officials Caught Illegally Downloading Music

French presidential officials have been caught illegally downloading copyrighted material; ironic, as the officials could have broken the Frenchthree strikes’ laws twice over.

Just as both employees of the U.S. Department of Homeland Security and the RIAA, one of the main proponents behind the controversial SOPA bill currently going through Congress, more high-profile organisations and government departments are found to be illegally downloading copyrighted material.

Enter the French president, Nicolas Sarkozy.

Members of staff at the Lysée Palace, home and office of the French president, could be found to be breaking some of the toughest anti-piracy measures in Europe, France’s own ‘three strikes’ law.

Last week, Russian website YouHaveDownloaded opened its doors as it claimed to track around 20 percent of all public torrent downloads. You can check your IP address and others against the database of almost 53 million users and over 110,000 tracked torrents to see if you or prominent others are found illegally downloading copyrighted material.

Sarkozy’s anti-piracy legislation involves cutting off pirates after three proven conditions, known as the ‘three-strike’ rule.

Husband to musician Carla Bruni, Sarkozy pushed through the controversial rule in the French parliament last year, thought to be the toughest anti-piracy law in Europe.

Reports suggest that around sixty French web users were on their third and final strike as of October this year.

According to TorrentFreak, a total of six infringing downloads were tracked back to Sarkozy’s residence, double the three-strike limit.

The Irish government had previously implemented a three-strike rule, but on Monday indicated that it would be replaced with a UK-like system where court orders could be invoked to block access to sites instead.

Along with the U.S. Department for Homeland Security and the RIAA, copyright holders themselves, from Sony, Universal and Fox employees were found to be downloading content — some of which belonged to their employers.

It would have been an almost perfect hypocrisy had Bruni’s music been illegally downloaded. Alas, it’s not the case. Someone clearly has a taste for The Beach Boys though.

What Exactly Is An Independent Label? Differing Definitions, Different Market Shares

Back in 2007 (June 30, Billboard) when I asked what is an indie, I got a multitude of answers. Today, that question evokes even more complex answers because the landscape has not only changed dramatically but is still changing.

Over the last 15 years, things have only gotten even murkier. Majors used to just buy indies; nowadays, they also invest in indies; and they even do joint ventures with indies-sometimes on an album-by-album basis. Going the other way, majors like RCA have also put artists like Ray LaMontagne through RED. In fact, there are so many permutations of indie/major collaborations and secret deals concerning those permutations that it’s sometimes hard to tell what’s still indie and what’s a major.

Even before things became as complex as they are now, SoundScan itself counted market share in two different ways. It has a label market share report, which used to tally market share by label and then add them up under each major distributor. It also had an album summary report, which in essence tracked market share by corporate ownership of distribution companies. (See figures 2 and 5 above).

Once upon a time, it was easy to calculate indie market share by distributor in Nielsen SoundScan. All you had to do was look at distributor market share by corporate ownership in the marketing summary reports and subtract out RED, Alternative Distribution Alliance and Caroline, respectively from Sony Music Entertainment, the Warner Music Group and EMI; and add their share in with the “other.” i.e., indie, category in SoundScan to come up with a good representation of indie market share. (See figures 3 and 6).

But that all began to change when the Universal Music Group started Fontana in 2004. From the get go, however, UMG, didn’t allow SoundScan to show that company’s market share; and instead had that share buried within UMG’s share. In other perhaps related moves, since Fontana’s market share was buried within UMG, the market share of RED and Caroline have been shifted, respectively by Sony and EMI from the summary report to the label album reports.

Other things have changed too, in this complex music industry. For example, Caroline evolved into EMI Label Services/Caroline that uses the EMI sales distribution ARM arm; ADA and WEA have one share sales team; Sony has acquired IODA, the independent digital aggregator; Universal has invested in InGrooves and its market share is included somewhere in UMGs.

But even before all those changes happened, without having the ability to know what Fontana’s market share was, Billboard made an editorial decision to keep an apple-to-apple comparison when tracking market share. The only way to do that was to use summary report market share totals, which meant that all the major-owned indie distributors would be counted under the majors. Unfortunately, that decision resulted in the smallest possible definition of independent market share (see figures 2 and 5) becoming the predominant one used, not only in Billboard, but often in the mainstream media, much to the chagrin of indie players.

With the dawning of the digital age, indie label and distributors often find themselves relegated to second-class citizen status as digital servers providers usually start out by giving preferential trading terms to the majors, but not the indies.

So when Google was putting together its cloud offering, sources say it started out by offering indie labels five percentage points less than the 58% split it offered the major labels. Moreover, while some services offered the majors big advances, indies are left out in the cold on the front-end.

Consequently, in the U.S. A2IM has been leading the charge to have indie market share redefined so that the ownership is also counted. In their definition (See figures 1 and 4), not only are the labels distributed by ADA, RED, Fontana, IODA (now owned by Sony) counted in indie market share but so are independently owned labels like Razor & Tie and Wind-up, both distributed by Sony; and labels like Hollywood, Concord and Big Machine, all distributed by Universal. In fact, A2IM claims that any label that is at least 50% owned by the indie partner, no matter who distributes it, is an indie and should be counted accordingly.

This isn’t a definitive market share either, since again there are many secret deals between indies and majors whereby it’s hard to determine which entity actually owns the master.  But this Billboard estimate was calculated using A2IM’S guidance on which labels are independently owned and using raw SoundScan data.

One last note, these market share pies aren’t exactly an apple to apple comparison since the 2007 market share pies are based on album market share and the 2011 pie’s are based on album market share plus track-equivalent market share whereby 10 digital downloads count as one album.  So while comparing market share in Figure 1 and 4, it looks like the indie’s slice of the pie is down the lower number now is due to the indie’s having lower market share for track-equivalent albums. If only albums were counted at mid-year 2011,indie album market share is actually 33% and absent from that market share is the shares of RoadRunner and Univision, which were counted as indies back in 2007, before they were bought by, respectively, WMG and UMG.

Apple Signs Deal With Universal Music Group for iCloud, Major Publishers Also on Board

As expected, Apple has signed the fourth major label — Universal Music Group — to a licensing deal for its new iCloud service, which is scheduled to be unveiled on Monday at its Worldwide Developer Conference, sources told Billboard today.

At the same time, Apple has also reach an accord with the four major music publishers licensing deals, sources said. The publishers nailed down a 12% of cloud revenue rate, while the major record labels are believed to be entitled to 58% of revenue, leaving Apple with the remaining 30%.

While sources said Universal and Sony Music Entertainment were asking for 60% of the revenue, they now suggest some sort of a comprise deal was reached at the last minute in order to accommodate the 12% of revenue royalty rate being paid to publishers.

Apple has yet to reach deals with the tens of thousands of independent publishers and labels. Sources say that it will offer indie publishers the same 12% rate it is paying the major publishers. However, Apple began negotiations with (more…)

In his modest Bed-Stuy, Brooklyn apartment, the man born Timothy Thedford spoke for over three hours about his almost Forrest Gump-like journey through this thing called life. I’ll stand still for two years, 20 years. I’m 34 years old. I’m still learning myself, but I know myself a little bit, so I stand still. People was telling me, “Oh, you buggin’, this is the time.”

By the time March [2010] came, it was crazy. I coulda signed any kinda deal at that time. I coulda took these publishing companies to the cleaners. I met anybody you can think of. Like, I’m gonna entertain what you sayin’, but we already have a fundamental disagreement in the way that we view the music business and the treatment of people, period. I need to feel like I’m talking to my grandmother. I need to feel like I’m talking to my sister or my mama to feel comfortable. If I’m not at that comfort level then I’m completely uncomfortable.

Rapper Paris Sues NBC For $20 Million

The Bay Area rapper claims NBC stole an idea from him.

Rapper Paris has filed a lawsuit against a producer, NBC Networks and Warner Brother Pictures, according to Allhiphop.com.

A lawsuit filed on December 7th indicates that Paris is accusing the defendants of stealing the concept for “Your School Makeover,” using it in the series “School Pride” instead.

The complaint indicates that the rapper copyrighted the concept for the show, and registered the domain name YourSchoolMakeover.com in June 2007.

“In or about early October, 2010, Plaintiff began receiving unsolicited telephone calls of congratulations for finally getting the work produced, in response to advertising on defendant’s NBC’s network School Pride,” says the complaint.

The rapper’s lawyers claim NBC ignored all warnings and denied any copyright infringement allegations.

Paris is suing NBC for $20 million dollars, in addition to statutory damages of $30,000 for five different charges of copyright infringement.

Black Sheep Unaware Of Kia Commercial

Apparently, Dres of Black Sheep wasn’t privy to the rapping hamsters in Kia’s latest ad campaign. D-R-E-S shares his thoughts with VIBE on the group’s song being used and how he’s expecting some royalties to come along with it.

“The Choice is Yours” is in a new Kia commercial and some other classic hip-hop songs have been getting commercial revivals too. What’s up with the resurgence of golden era hip-hop in advertising?
I think it’s reflective of a time period of a certain level where it was good feelings. Certain songs just represent a good feeling and I think “The Choice is Yours” is one of those that was so fortunate to have that life. There are songs that⎯like with when Obama won⎯you knew where you were and what you were doing and “The Choice is Yours” is like that. I didn’t have any time to do any form of huge promotion globally so at this time that I got an album coming out, it’s such a blessing that so many people are turning their heads to notice, wow Black Sheep, what’s Dres up to? But it kind of goes to the walk of an artist especially from my era⎯everything was kinda young and this Kia commercial, I didn’t even have anything to do with it.

So you didn’t even know it was going to happen?
I wasn’t even contacted. I have yet to receive payment on it but don’t get it twisted, I will. I’ve been talking to Kia for the past week or two so certain things might be done moving forward in maximizing what we’re trying to do. But Universal, the record label, was basically the ones that signed off on it and gave them permission to use my likeness so that’s a different story that might wind up having a life of itself as well. I wouldn’t say that the label did everything that they were supposed to do but that goes to us being young artists and not understanding some of
the things that we were signing. I would say to the artists today⎯and this is 20 years later⎯that I’m not the administrator of some of the things that I should be especially so far down the road. But God moves in mysterious ways and I see it as a blessing at the end of the day.

Freeway Ricky Ross To Sue Rapper Rick Ross, Universal & Def Jam Over Name

could face off against the rapper Rick Ross (William Leonard Roberts II) in court this summer, over the usage of the name “Rick Ross.”

Rick Ross controlled thousands of workers at the height of his power in the mid-1980’s, who dealt millions of dollars worth of cocaine each day.

In 1995, Ross was sentenced to life in prison for attempting to purchase over 100 kilograms of cocaine.

Ross was released from prison in 2006 and attempted to reclaim his name.

Ross claims that Miami rapper Rick Ross (William Leonard Roberts II) signed a multimillion dollar deal in 2006, based on his image and likeness as a drug dealer.

Universal Betting On Lower Prices To Boost CD Sales

Universal Music Group (UMG) is embarking on one of the most ambitious efforts yet to boost U.S. CD sales, with the test of a new pricing structure designed to sell most new releases by current artists at $10 or less at retail.

The major’s “Velocity” pricing program responds to the continuing plunge in CD sales, taking aim at brick-and-mortar retail stores that have scaled back on floor space dedicated to music. The pricing adjustments will also bring CD prices more in line with what consumers pay for digital albums at online retailers like iTunes and Amazon.

“We think it will really bring new life into the physical format,” Universal Music Group Distribution chairman/CEO Jim Urie says.

Universal, which accounts for 28.7 percent of year-to-date U.S. album sales, according to Nielsen SoundScan, will cut UMG’s main wholesale price point of $10.35 to about $7.50 or less for front-line releases, which are generally by established current artists. It’s also breaking with prevailing industry practice by putting suggested retail prices on CDs, ranging from $6 to $10.
